1. What is CASL?

Canada's Anti-Spam Legislation (CASL) is one of the world's strictest anti-spam laws. It governs the sending of commercial electronic messages (CEMs) to Canadian recipients. CASL requires senders to obtain consent, provide identification, and include an unsubscribe mechanism in every commercial email.

MailSpaceAI provides built-in tools to help you comply with CASL, including consent tracking, unsubscribe management, and sender identification fields.

2. MailSpaceAI's CASL Compliance

MailSpaceAI as a platform complies with CASL in the following ways:

  • We only send transactional and service-related emails to our registered users
  • All marketing communications include a clear unsubscribe mechanism
  • We honour unsubscribe requests within 10 business days
  • We clearly identify MailSpaceAI as the sender in all communications
  • We maintain records of consent for our own email communications

3. Your Responsibilities as a MailSpaceAI User

When using MailSpaceAI to send email campaigns to Canadian recipients, you are responsible for CASL compliance. This includes:

3.1 Obtaining Consent

You must obtain either express consent or implied consent before sending CEMs:

  • Express consent: The recipient has explicitly agreed to receive your emails (e.g., via a sign-up form with a clear opt-in checkbox)
  • Implied consent: Exists where there is an existing business relationship, e.g., a customer who purchased from you in the past 2 years, or a person who has published their email address publicly

3.2 Identification Requirements

Every CEM must clearly identify:

  • Your name (or the name of the person on whose behalf the message is sent)
  • Your mailing address and either a phone number, email address, or web address

3.3 Unsubscribe Mechanism

Every CEM must include a functional unsubscribe mechanism that:

  • Is clearly and prominently displayed
  • Allows the recipient to unsubscribe at no cost
  • Remains functional for at least 60 days after the message is sent

MailSpaceAI automatically includes an unsubscribe link in campaign emails. Ensure you do not remove or disable this feature.

4. Consent Records

CASL requires you to maintain records of consent. MailSpaceAI's contact management system allows you to record and track consent status for each recipient. We recommend documenting:

  • How and when consent was obtained
  • The specific type of consent (express or implied)
  • The scope of consent (what types of messages the recipient agreed to receive)

5. Penalties for Non-Compliance

CASL violations can result in significant penalties – up to CAD $1 million per violation for individuals and CAD $10 million per violation for organisations. MailSpaceAI is not liable for your non-compliance with CASL when using our platform.
