1. What is the CAN-SPAM Act?

The CAN-SPAM Act (Controlling the Assault of Non-Solicited Pornography And Marketing Act) is a US federal law that sets rules for commercial email, establishes requirements for commercial messages, gives recipients the right to stop receiving emails, and spells out penalties for violations.

2. CAN-SPAM Requirements

The CAN-SPAM Act requires all commercial email messages to comply with the following rules:

2.1 Don't Use False or Misleading Header Information

Your "From", "To", "Reply-To", and routing information must accurately identify the person or business who initiated the message. MailSpaceAI sends emails from your authenticated Gmail account, ensuring accurate sender identification.

2.2 Don't Use Deceptive Subject Lines

The subject line must accurately reflect the content of the message. Misleading subject lines are prohibited.

2.3 Identify the Message as an Advertisement

If your email is a commercial advertisement, you must disclose this clearly and conspicuously, unless the recipient has given prior affirmative consent.

2.4 Include Your Physical Address

Every commercial email must include a valid physical postal address – either your current street address, a registered P.O. Box, or a private mailbox registered with a commercial mail receiving agency.

2.5 Include a Clear Unsubscribe Mechanism

Every commercial email must include a clear and conspicuous explanation of how the recipient can opt out of receiving future emails. MailSpaceAI automatically includes an unsubscribe link in campaign emails.

2.6 Honour Opt-Out Requests Promptly

You must honour opt-out requests within 10 business days. MailSpaceAI processes unsubscribe requests immediately and prevents future campaign sends to unsubscribed contacts.

2.7 Monitor What Others Do on Your Behalf

If you hire another company to handle your email marketing, both you and the company are legally responsible for CAN-SPAM compliance.

  • Sending all emails from your authenticated Gmail account with accurate sender information
  • Including automatic unsubscribe links in all campaign emails
  • Processing unsubscribe requests immediately and maintaining suppression lists

  • Not sending emails on your behalf without your explicit instruction

4. Your Responsibilities

As a MailSpaceAI user sending commercial emails, you are responsible for:

  • Using accurate and non-deceptive subject lines and sender information
  • Including your physical mailing address in campaign emails
  • Not removing or disabling the unsubscribe mechanism
  • Honouring unsubscribe requests within 10 business days
  • Not sending to email addresses obtained through address harvesting or dictionary attacks
  • Ensuring your email content complies with all applicable laws

5. Penalties

Each violation of the CAN-SPAM Act is subject to penalties of up to $51,744. MailSpaceAI is not liable for your non-compliance when using our platform.
